The applicant, the applicant’s employees, agents, or volunteers associated with the activity for which the application is being sought, agrees to waive and relinquish all claims and to hold harmless Brasstown Valley Resort and Spa and the Mountain Arts Association, Inc., their employees, agents, or volunteers from and against any and all legal actions, claims, damages, losses, or expenses arising from participation in the Brasstown Resort Art Gallery exhibition located in the Brasstown Valley Resort facility; and further, any activity associated with the conduct of the applicant’s property (art work) including, but not limited to, claims of personal and bodily injury to or destruction of the property (art work). The above excludes claims caused by the willful commission or omission by the employees of Brasstown Valley Resort and Spa and any of its agents, employees, and authorized volunteers for any attorney’s fees and court costs incurred or to be incurred in depending any actions brought them as a result of the applicant’s use of public property as set forth in this application. I have read and understand the above liability and hold harmless waiver.
